AuditQMS Pro Suite

These Terms of Service ("Terms") govern your access to and use of the AuditQMS Pro Suite website and web application (together, the "Service"), provided by AuditQMS Pro Suite (Pty) Ltd ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.

1. Using the Service

You may use the Service only in compliance with these Terms and all applicable laws. You are responsible for the accuracy of the information you enter into the Service, including audit records, findings, CAPA actions, risk assessments, and any personal information of employees, suppliers, or customers you choose to capture.

2. Free Trial

We offer a 30-day free trial with full access to the Service. No credit card is required to start a trial. We reserve the right to modify or end the free trial offer at any time.

3. Your Data

You retain ownership of all data you enter into the Service. We do not claim ownership over your audit records, findings, CAPAs, risk assessments, documents, or other workspace content. You are responsible for maintaining your own backups where appropriate, particularly where local browser storage is used.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload malicious code or attempt to disrupt the Service
• Attempt to gain unauthorized access to other users' data or systems
• Use the Service in a way that infringes the rights of others

5. Subscription and Payment

Paid plans are billed as described on our Pricing page. Prices are shown in South African Rand (ZAR), excluding VAT unless stated otherwise. You may upgrade, downgrade, or cancel your plan at any time; changes take effect according to your billing cycle.

6. Compliance Disclaimer

AuditQMS Pro Suite is a tool to help you manage quality, safety, health, environmental, and compliance records. It does not constitute legal, regulatory, or certification advice, and using the Service does not guarantee compliance with ISO 9001, ISO 22000, FSSC 22000, ISO 45001, BRCGS, HACCP, R638 of 2018, the OHS Act 85 of 1993, or any other standard or regulation. You remain responsible for your organization's compliance obligations.

7. Availability

The Service is provided on an "as is" and "as available" basis. While the Service is designed to work offline, features that rely on cloud sync or connectivity may be unavailable without internet access. We do not guarantee uninterrupted or error-free operation.

8. Limitation of Liability

To the fullest extent permitted by law, AuditQMS Pro Suite (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service for violation of these Terms, with notice where reasonably practicable.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
